Payment Policy

Please, review and understand this payment policy ("Payment Policy") carefully. It applies to any user who uses the LEARN Anywhere website and affiliated tools to enter into an agreement with another user (collectively, the “Services”). 


Under this Payment Policy, the pronouns “we”, “us” or “our” refer to LEARN Anytime Anywhere, while the pronouns “you” or “your” refer to any user entering into a Class Contract (defined below) with another user via the Services. 


Capitalised terms that are not defined under this Payment Policy have the meanings ascribed to them under our general Terms and Conditions. Also, read the other LEARN Anytime Anywhere terms and policies that apply to you, including our Privacy Policy, Cookie Policy, Community Policy, Teacher Policy and Teacher Code of Conduct and Class Policy (collectively, other “Policies”). All Policies can be found here.


  1. Class Contract

Upon confirmation of Teacher Services, time and price by both the Parent/Student and the Teacher, such Parent/Student and Teacher shall be considered as entering into a contract, under which the Parent/Student agrees to purchase, and the Teacher agrees to deliver, the Teacher Services (the "Class Contract"). You agree not to enter into any contractual provisions that conflict with our Terms and Conditions or other Policies. The Parent/Student and Teacher each covenant and agree to act with good faith and fair dealing in the performance of the Class Contract. 


Furthermore, the Parent/Student and Teacher each acknowledge and agree that the value, reputation and goodwill of the Services depends on their performance of the foregoing covenants and agreements. The Parent/Student and the Teacher, therefore, agree that LEARN Anytime Anywhere has the right to take such actions with respect to the Class Contract, including without limitation suspension, termination or legal actions, as we, in our sole discretion deems necessary to protect the value, reputation and goodwill of the Services.


  1. Financial Terms (Parents/Students)

  1. Purchasing Teacher Service

In order to enter into a Class Contract as a Parent/Student, you may use any accepted payment method on the Services to pay for the desired Teacher Service through your user account. By providing LEARN Anytime Anywhere with the required information for the applicable payment method, you are authorising us to charge the equivalent fee (the “Enrollment Fee”) you selected on the payment page of your user account plus a transaction fee of 3%. Following a successful transaction, you acknowledge and agree that your purchased amount will be used to pay LEARN Anytime Anywhere and the Teacher for the Teacher Services via the Site. 

  1. Confirmation of Class

As a Parent/Student, when you do not contact us for any dispute within 5 days after the Class ends, you are confirming that the Teacher has completed the applicable Teacher Services fully and satisfactorily, and you are instructing LEARN Anytime Anywhere to transfer the applicable Enrollment Fee to the Teacher.

  1. Third-Party Payment Method Charges

When you purchase any Class or Teacher Services through the Services, additional charges may be charged to your selected payment method by the applicable payment provider as processing fees. Any such payment provider charges are not under our control, and we disclaim any and all liabilities in this regard. Whatever payment method you use may be subject to additional terms and conditions imposed by the applicable payment method provider, which we recommend that you review before using such payment method.

  1. Class Cancellation

Any Parent/Student can cancel a Class and get a refund within 7 days after they sign up. If a Parent/Student wishes to cancel a Class before the Class start time, it is the Teacher’s discretion to refund or transfer the Student to another Class. If a transfer to another Class cannot be arranged by the Teacher, the Parent/Student will not be entitled to a refund.

  1. Refund Policy

  • If the Teacher cancels a Class in advance, the Parent/Student will receive a full refund of the Enrollment Fee upon request.

  • If the Teacher misses a one-time Class, the Parent/Student will receive a full refund of the Enrollment Fee.

  • If a Class start time is rescheduled by the Teacher, the Parent/Student will have the option to request a refund of the Enrollment Fee or a transfer to another Class. 

  • If a part of a Class is rescheduled by the Teacher, the Parent/Student will have the option to request a refund of a pro-rated refund based on the number of meetings that were rescheduled that the Student cannot attend or a transfer to another Class.

  • If the Teacher does not teach the number of meetings in the Class Contract, the Parent/Student will receive a pro-rated refund.

  • If the Teacher cancels a Class in progress, the Parent/Student will receive a pro-rated refund based on the percentage of meetings the Parent/Student paid for that were cancelled.

  • If the Student misses a Class, the Parent/Student will not be entitled to a refund.

  • If a Student is late for a Class, the Teacher does not have to wait for the Student if there are other students already in the class. However, should the late student be the only student enrolled in that Class, the Teacher should be available to start the Class at any time during the scheduled period for the Class. However, the teacher is under no obligation to make up for any lost time or teach beyond the scheduled time due to the Student's late arrival.

  • If a Class starts more than 5 minutes late or ends more than 5 minutes early, the Parent will receive a 50% refund if less than half of the Class was missed, and a full refund if more than half was missed.

  1. Feedback and Ratings on Classes

As a Parent/Student, when you confirm a Class is successful, you may be asked to leave feedback and a rating (“Feedback”) for the Teacher Services. Leaving Feedback is optional; however, if you do so, you agree that your Feedback will be genuine and honest and that it will not be misleading, fraudulent, nor spam, insult, harass, threaten or otherwise go against any ethics. You agree to report violations or abuses of our Feedback system by contacting Customer Service at support@learn-anytime-anywhere.com, and agree not to take any actions that undermine the integrity of the feedback system.


  1. Financial Terms (Teachers)

  1. Accepting Class Requests

Each Teacher will list his/her desired Classes and Teacher Services on the Services. If any Parent/Student enrols into such Classes, LEARN Anytime Anywhere will send a notification to such Teacher’s email address and user account dashboard. By posting any Teacher Services or Classes, you agree to provide them to the enrolled Students at the date and time described in the applicable Class details.


  1. Cancellations of Class Requests

As a Teacher, you acknowledge and agree that LEARN Anytime Anywhere may, in our sole discretion, cancel a confirmed Class in accordance with our Terms and Conditions and other Policies. You further acknowledge and agree that we and the relevant Parent/Student will not have any liability for such cancellations or refunds.


  1. Commission

LEARN Anytime Anywhere collects a certain percentage commission of the Enrollment Fee after the completion and confirmation of a Class by the Parent/Student. For each successfully completed Class, the commission is 15-25% of the Enrollment Fee of such Class (the "Commission") based on the commission table below. The Commission will be deducted upon the transfer of the Enrollment Fee to the Teacher's desired payout method.

The available funds shown in the Teacher’s payout report is the full balance after the Commission and necessary deductions have been deducted from the Enrollment Fee (“account balance”). Amounts may be rounded up or down as described under the "Rounding Off" in paragraph (g) below.


To the extent any refunds are issued to a Parent/Student, no Commission will be charged to the Teacher with respect to the Enrollment Fee that is refunded back to the Parent/Student.


  1. No Circumvention of Commission

Teachers shall not engage in any action or activity meant to circumvent the Commission, with such actions or activities including, but not limited to, suggesting, soliciting or accepting payment outside of the Services, or by other means other than through the Services.


  1. Withdrawal of Funds

When withdrawing any funds from your account balance, you may be charged additional fees by the third party that provides the applicable method of withdrawal. These fees are not under LEARN Anytime Anywhere's control; therefore, we disclaim all liability in this regard. Whatever method of withdrawal you use may be subject to additional terms and conditions, which we recommend that you review before using such a method of withdrawal.


  1. Withholding or Delaying Disbursement of Funds

If LEARN Anytime Anywhere determines that a Teacher's actions may have resulted (or will result) in a significant number of disputes, refunds or other claims from Parents/Students who purchased such Teacher’s Classes, LEARN Anytime Anywhere reserves the right to delay or stop the disbursement of all funds accrued in such Teacher's account balance. If LEARN Anytime Anywhere reasonably concludes that a Teacher has violated our Terms and Conditions or other Policies, we may refuse to disburse the funds accrued in such Teacher's account balance and debit such funds from the Teacher account balance.


  1. Rounding Off

We may, in our sole discretion, round up or round down amounts that are payable from or to Teachers or Parent/Students to the nearest whole functional base unit in which the currency is denominated (e.g. to the nearest dollar); for example, we may round up an amount of $101.50 to $102.00 and may round down an amount of $101.49 to $101.00.


  1. Taxes

Teachers shall be solely responsible for determining their applicable tax-related duties in connection with the income obtained from their Class sales and Teacher Services, and shall also be solely responsible for remitting to the relevant authority, any applicable taxes that need to be paid. LEARN Anytime Anywhere cannot and does not offer tax-related advice to any Teachers.


  1. Our Rights Regarding User Accounts and Funds

  1. Security and Financial Fraud

As a security measure, LEARN Anytime Anywhere may impose transaction limits on some or all Parent/Students and Teachers relating to the value of any transaction or disbursement, the cumulative value of all transactions or disbursements during a period of time, or the number of transactions per day or other periods of time. We will impose these limits before any services are rendered if we determine it is necessary for security reasons or the prevention of fraud.


We also reserve the right to void any purchases on the Services if such purchases are found to be fraudulent.


  1. Reservation of Rights for Erroneous Transactions

LEARN Anytime Anywhere reserves the right to seek reimbursement from any Teacher or Parent/Student, if we, in our sole discretion, determine that erroneous or duplicate transactions have occurred. We may obtain such reimbursement by deducting from future payments owed to such Teacher, by reversing any funds to such Teacher's account balance, or by seeking reimbursement from such Teacher by any other lawful means.


  1. Prohibition on Friendly Fraud

"Friendly Fraud" under this Payment Policy refers to a situation where a user initiates a fraud dispute with a payment provider, claiming that their credit card (or other payment methods) was not intended to be used. This type of behaviour is illegal and prohibited by all payment providers. LEARN Anytime Anywhere also strictly opposes Friendly Fraud. If Friendly Fraud is discovered, the Parent/Student's user account will be deactivated, and the Parent/Student will be noted as a financial security risk.


In the case of honest mistakes, LEARN Anytime Anywhere can reverse the transaction. We strongly advise Parent/Students to contact our Customer Service at [email protected] to resolve any financial disputes.


  1. Prohibitions

In addition to complying with the prohibitions in relation to your use of the Services as described in our Terms and Conditions, you understand and agree that you are solely responsible for complying with any applicable laws, rules, regulations and tax obligations that may apply to you in connection with the use of the Payment Services. In addition, you may not, and you agree that you will not:

  1. Violate any local, state, provincial, national or other law or regulation, or any order of a court, such as money laundering and internet fraud or theft;

  2. Use the Services for any commercial or other purposes that are not expressly permitted by this Payment Policy;

  3. Use the Services to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, personal contact information or credit, debit, calling card or account numbers, or photographs of others without their permission;

  4. Register or attach any method of payment or method of withdrawal that is not yours or which you do not have the authorisation to use with your user account;

  5. Attempt to probe, scan or test the vulnerability of any of our systems or networks or otherwise breach any security or authentication measures;

  6. Bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by LEARN Anytime Anywhere or any other third party to protect the Services;

  7. Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services to send altered, deceptive or false source-identifying information;

  8. Attempt to decipher, decompile, disassemble or reverse-engineer any of the software used to provide the Services;

  9. Use credit cards or other payment methods fraudulently; or

  10. Advocate, encourage or assist any third party in doing any of the foregoing.


To the fullest extent permitted by applicable law, LEARN Anytime Anywhere reserves the right to investigate and take actions if you violate any of the above provisions. In addition, and as described in this Payment Policy, we may take a range of actions against you, which may include without limitation, limiting your user account access to the Services. 


  1. Disputes Between Users

This section applies to any claims or disputes that exist between a Teacher and Parent/Student in relation to payments under the Services. In the event of a disagreement between a Teacher and a Parent/Student, we encourage both parties to try and settle such disputes informally. 


If both users are unable to resolve such disputes informally, then either of the users may submit such disputes to us by contacting our Customer Service via [email protected]. We may request that both the Teacher and Parent/Student provide communication records regarding the dispute, which should show all key relevant information, including the time, date and communication details. Although LEARN Anytime Anywhere will attempt to evaluate the dispute on an impartial basis, we will have the authority to resolve the dispute in our sole discretion, and our resolution of the dispute will be final and binding. As a result, we shall have the right, in our sole discretion to:

  1. transfer credits, offer a refund or reverse a transaction; and

  2. designate who shall bear the Commission resulting from any such actions.


  1. Parent/Student Satisfaction

It is LEARN Anytime Anywhere’s goal to ensure the Students are happy with the Classes and Teacher Services received via the Service. If any Teacher Service was not completed according to the final scope agreed, we would work with you and the Teacher to correct the problem. If you are not satisfied with any Class, you must let the applicable Teacher and LEARN Anytime Anywhere know within 5 days after the Class ends. If we do not hear from you about a Class after 5 days it ends, we will process your Enrollment Fee to the Teacher.

  1. Updates to Payment Policy and Commission

LEARN Anytime Anywhere reserves the right to review and update any part of this Payment Policy, including our Commission, with or without notice or liability. Updates to this Payment Policy may be as a result of changes to any features on the Services, any applicable law or regulation or our method of handling payments. We advise that you review this Payment Policy frequently to be apprised of any updates to it. 


By your continued use of the Services after any updates to this Payment Policy (including an increase to our Commission), it constitutes your consent to be bound by such updates.
